Endowment (Waqf) is the most prominent manifestation of the spirit of social co-operation and it is one of the most important pious gifts having the quality of the continuous reward that is based on the sense of co-operation and altruism with the aim of expanding social justice. The implementation and provision of justice, economic, cultural and social development can be provided by the endowment. The good tradition of endowment has a profound historical background in Iran and has been the source of many valuable cultural, educational, religious effects in the community over many years, especially after Islam. In this paper, the concept of endowment institution and its position in the legal system of Iran has been examined and compared with other institutions in the other legal systems.
