http://www.ijhcs.com/index.php/ijhcs/index Page 2427 Long Steps of Irans Rights in Further Coordination with Berne Convention and WIPO Treaty about Royalty (copyright) Sattar Zarkalam Assistance of professor, Department of private law, college of human science, shahed Tehran, Iran Email:sattarzarkalam@gmail.com Abstract Authors, composers and artists protection law of 1969 as the first coherent law about protection the literary and artistic works in spite of objections after 50 years from its approval is one of the most advanced laws in Middle East countries. However, this law and other laws needs revising due to the unimaginable advancement of information and communicational technologies and existing different forms of literary and artistic works and complexity of social relations. Attempts to prepare new bill literary and artistic property rights that begin more than 10 years leads in codifying bill of intellectual property –first book: artistic and literary property and related rights in 2014 that it is offered to the Islamic Consultative Assembly and it is in the approval process in this assembly. This bill in its form and its nature changes the literary and artistic property rights specially literary and artistic works rights which constitute the subject of this paper. If the aforementioned bill is passed, it causes that Irans rights more coordinates with Berne convention and treaty of copyright (copyright) is held in the framework of World Intellectual Property Organization (WIPO) named WCT and it will prepare the necessary legal structures in order to connect to agreement on Trade- related aspect of Property Rights named TRIP,S; a fact that makes it easy to join the world trading organization. Furthermore, these evolutions in this bill causes that the authors rights of literary and artistic works is protected effectively like in industrial developed countries. Meanwhile, the bill of 2013 is not correlated with the aforementioned international regulations. We can refer to the lack of protection in indictable rights and related information with legal system management.
